3. Use of Website

  • 3.1 Eligibility: You must be at least 18 years old to use our website and services.

4. Fees and Payment

4.1 Fees: Fees for our services will be agreed upon in writing prior to the commencement of any project. All fees are non-refundable unless otherwise specified.

4.2 Payment Terms: Payment is due within 30 days of the invoice date unless otherwise agreed in writing. Late payments may incur interest at the rate of 1.5% per month.

5. Intellectual Property

5.1 Ownership: All intellectual property rights in the materials we create for you will be owned by NovaMass until full payment has been received. Upon payment, ownership of the final deliverables will transfer to you, subject to any third-party rights.

5.2 License: You grant NovaMass a non-exclusive, royalty-free, worldwide license to use your name, logo, and any content provided by you for the purpose of providing our services.

6. Confidentiality

Both parties agree to keep all confidential information received from the other party confidential and not to use or disclose it to any third party except as necessary to perform our services or as required by law.

7. Limitation of Liability

To the fullest extent permitted by law, NovaMass shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of our services.

8. Indemnification

You agree to indemnify, defend, and hold harmless NovaMass, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your use of our services or breach of these Terms.

9. Termination

We reserve the right to terminate or suspend your access to our services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users of our services, us, or third parties, or for any other reason.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in United States, Washington, and you hereby irrevocably consent to the personal jurisdiction and venue therein.

NovaMass reserves the right to update or modify these Terms at any time without prior notice. Your continued use of our services following any such change constitutes your agreement to follow and be bound by the Terms as modified. For this reason, we encourage you to review these Terms whenever you use our services.
